GEORGETOWN, Ohio — Two men have been sentenced by Judge Scott Gusweiler in the Brown County Court of Common Pleas.
On Oct. 31, an eight-count indictment was filed against Austin Gabriel. The indictment charged Gabriel with two counts of first-degree rape, which has a maximum penalty of 11 years in prison and a $20,000 fine upon conviction; third-degree sexual battery with a maximum penalty of 36 months in prison and a fine of $10,000; two counts of gross sexual imposition, and two counts corrupting another with drugs, both fourth-degree felonies with a maximum penalty of 18 months in prison and a $5,000 fine; and finally, one count of unlawful sexual conduct with a minor.
On Jan. 3, Gabriel entered a guilty plea to two counts from the indictment. Gusweiler sentenced Gabriel to 14 months in the Ohio Department of Corrections. Gabriel was advised of the reporting requirements of a Tier I Sex Offender, with a 15-year registration requirement every 365 days; also 14 months in prison on another count, to be served consecutively to the sentence imposed in count four. Gabriel was also advised that he could not live within 1,000 feet of a school, pre-school, or daycare center. Counts one, two, three, five, six and eight were all dismissed.
On Dec. 12, a one-count indictment was filed against Gerald T. Dickens. The indictment charged Dickens with aggravated possession of drugs which has a maximum penalty of 12 months in prison and a $2,500 fine.
On Jan. 6, Dickens entered a guilty plea before Gusweiler who sentenced Dickens to two years of community control sanctions, subject to general supervision and control of the Adult Probation Department.
