An empty gas tank proved to be fatal for a Tollesboro man Monday, police said.

According to information from the Maysville Police Department, Jimmy Polley, 45, of Tollesboro, ran out of gas on Kentucky 9 AA Highway between Kentucky 11 and Maple Leaf Road. Polley, who was headed northbound, pulled his vehicle onto the shoulder of the roadway, police said.

At about 6:44 a.m., Polley was in the process of putting gas into the vehicle’s fuel tank when he was struck by another vehicle driven by Jeffrey Kamer, 37, of Vanceburg, who was traveling northbound in the right-hand lane of the highway. Police said Kamer’s vehicle sideswiped Polley’s parked vehicle and Polley.

Polley was pronounced dead at the scene of the accident by Mason County Coroner David Lawrence.

Officers said Kamer has cooperated with police during the investigation and that use of neither drugs nor alcohol on Kamer’s part is suspected.

The highway was closed for several hours are accident reconstuctionists worked to determine the cause of the accident.

MPD was assisted at the scene by Maysville Fire and EMS, Mason County Emergency Management and Lawrence.

The accident remains under investigation by MPD.
